There is a maintenance period of twelve (12) months (“the maintenance period”) from the settlement date of the newly built house sold by Home Factor Ltd (“Home Factor”). Home Factor will carry out, during or within a reasonable time from the expiry of the maintenance period, all maintenance work arising from faulty materials or workmanship, at Home Factor’s cost and in compliance with the Building Act 2004 and the Building Code, which are notified by the Purchaser in writing to Home Factor before to the expiry of the maintenance period. For the avoidance of doubt, Home Factor will not be required to repair damage caused by the Purchaser or the Purchaser’s employees, contractors or visitors or caused by fire, earthquake, tempest or other occurrences normally.
This maintenance provision does not derogate from the implied warranties under the Building Act 2004 which apply to the contract entered as part of purchasing the newly built house. Home Factor agrees to take all reasonable steps to provide assistance so that the benefit of the same is available to and enforceable by the Purchaser.
